What does the refusal clause say?

HHS is proposing that certain "religious employers" be allowed to refuse to provide contraceptive coverage for their employees.
To qualify, an employer would have to meet this four-part test:

  1. The inculcation of religious values is the purpose of the organization. 
  2. The organization primarily employs persons who share the religious tenets of the organization. 
  3. The organization serves primarily persons who share the religious tenets of the organization. 
  4. The organization is a nonprofit organization as described in section 6033(a)(1) and section 6033(a)(3)(A)(i) or (iii) of the Internal Revenue Code of 1986, as amended.

Which entities would qualify? Churches, synagogues, mosques, seminaries and religious orders

Which would NOT qualify? Hospitals and social services agencies

Contraception is Prevention!
Don’t deny it to any woman!

That’s the message we need to HHS Secretary Kathleen Sebelius. HHS is seeking comments until September 30 on its proposed religious employer exemption from the contraceptive coverage mandate in the Women’s Preventive Services rule issued in August.

Conservative religious leaders are pressuring HHS to make the proposed religious employer exemption broader. This could allow religious hospitals and charities to deny contraceptive coverage to thousands of women who work for them.

We must raise our voices loud and clear in opposition to a religious employer exemption that denies any woman the contraceptive coverage she wants.
